Special board to tell HC if disabled teen can become doctor : MUMBAI

A special medical board will place before Bombay high court its report which will determine whether a partially disabled teenager from Solapur can study MBBS.

A division bench of Chief Justice Mohit Shah and Justice M S Sanklecha will hear a petition by Rajdeep Deshmukh (18), a resident of Barshi in Solapur district, urging direction to the Director of Medical Education and Research to allow him to pursue MBBS course.

Rajdeep suffers from phocomelia - an extremely rare congenital disorder involving malformation of the limbs - where two fingers on his left hand and two fingers on his right hand toes are shortened. The main cause of phocomelia is use of thalidomide and from generic inheritance.

Rajdeep's advocate Pooja Thorat, at the previous hearing, told the court his mother was prescribed the drug which is used against nausea and to alleviate morning sickness in pregnant woman. "Being unaware completely unaware of its side effects, she took it. Thorat said the drug was banned even at that point of time due to its severe side effects. The drug is still available in the market and is sold over the counter," she added.

Rajdeep's petition said he scored 78.50 per cent in HSC in Science. During practicals, he handled various equipments and also prepared slides and participated in experiments like a normal student. Thorat submitted that if Rajdeep secures admission to MBBS, after passing it, he will seek admission to a post graduate course which will not involve surgery.

Assistant government pleader Abhinandan Vagyani submitted a July 3, 2013 certificate issued by the Special Medical Board for Physically Handicapped certifying Rajdeep as an individual with 46 percent permanent locomotor disability in lower limbs and 33 percent permanent locomotor disability in upper limb. It stated that he is not eligible for claim of physically handicapped student and is unfit for Health Science course.

The judges then directed the DMER to send him for another medical examination before a Special Medical Board at JJ Hospital on September 3, 2011. They directed the J J Hospital board to assess Rajdeep's case of disability in the context of functional disability to study and practice medicine. The report will be placed before the court today.
