HC awards Rs 37.76 lakh to accident victim : Bangalore

The High Court of Karnataka on Wednesday awarded a compensation of Rs 37.76 lakh to a 24-year-old youth who had sustained disability due to a road accident.

In April 2007, B Puneet, a native of Kolar, was on his way to Bangalore on a four-wheeler when a speeding KSRTC bus rammed his vehicle and Puneet sustained grievous injuries. The Motor Accident Claims Tribunal, Kolar, awarded a compensation of Rs 50,000 to the victim. The medical report said Puneet had sustained 80 per cent disability.



V Balaji, Puneet’s father, approached the High Court seeking enhancement of the compensation.


Counsel for the petitioner, Pawan Chandra Shetty, submitted that the victim had become immobile and sought a compensation of Rs 67 lakh. He stated that Puneet was treated as in-patient for five months in a hospital and spent more than Rs 25 lakh as medical expenses. He has lost his memory and is dependent on his parents for daily chores.



Justice H G Ramesh directed the Reliance General Insurance, Karnataka State Road Transport Corporation and others to jointly pay a sum of Rs 37.75 lakh compensation to the victim.


Apology tendered



BDA Commissioner T Sham Bhat on Wednesday tendered apology to the court in a petition challenging land acquisition by the agency.



Lakshmamma had challenged the acquisition of five guntas of land for the formation of a layout by the BDA. She had contended that the property surrounding her land was dropped from acquisition while her property was not denotified.


The Court has asked the BDA to furnish the layout plan of Banashankari 6th stage, the extent of land acquired and land dropped from acquisition process. When the agency failed to provide the details, the court gave a dressing down to the BDA commissioner and had questioned why he should not be put behind bars for not complying with its order. The matter came to an end with Bhat tendering an apology on Wednesday.
