A physically challenged candidate belonging to the scheduled caste
community has moved the Madras high court seeking his appointment as
assistant public prosecutor (APP).
M Gurunathan, 38, suffering
from 55% permanent disability of his leg, was not selected for the post
of APP despite clearing the test and interview conducted by Tamil Nadu
Public Service Commission (TNPSC) in 2012. He had applied for the post
under the reservation category.
Gurunathan later filed an RTI which revealed that 40 persons had
been selected provisionally and the reserved post was kept vacant for
the 'want of suitable candidate.'
His writ petition stated that
the selection was 'arbitrary and against the principles of natural
justice.' He submitted that keeping the vacancy unfulfilled was 'non
application of mind by TNPSC.'
In his writ petition, Gurunathan sought his appointment as APP under the physically challenged quota.
