The court of additional sessions judge V K Shewale on Friday directed the superintendent of Yerawada Central Prison to refer MSRTC
bus driver Santosh Mane to the Yerawada mental hospital for expert
opinion on his mental status. Shewale passed the order amid strong
objections from the prosecution on a plea filed by Mane's lawyer
Dhananjay Mane that he should be referred to a psychiatrist or clinical
psychologist as he was unable to make a statement on the point of
sentencing.
Citing a judgment of the Delhi HC in the case of Yogesh Kumar and others, Mane's lawyer pleaded to conduct medical examination of his client for checking his mental state before recording his statement on the point of sentencing as per the directions of the Bombay HC.
Public prosecutor Ujjwala Pawar opposed the plea saying that the court was not conducting a re-trial and relied on Mane's medical reports for arguing that he was not suffering from mental illness.
After hearing both the sides, Shewale directed the jail superintendent to refer Mane to a mental hospital.
